Many people assume that long-term disability benefits continue indefinitely if they remain ill or injured.
However, most disability policies contain specific definitions of disability that change over time.
Understanding these definitions is critical to protecting your benefits.
The “Own Occupation” Period
Many LTD policies begin with an “own occupation” definition of disability.
During this period, you are considered disabled if you are unable to perform the duties of your specific job. For example, if you were working as:
- a nurse
- a construction worker
- a lawyer
- a teacher
You only need to show that your condition prevents you from performing the duties of that occupation.
This period typically lasts 24 months.
The “Any Occupation” Definition
After two years, many (but not all) policies change to the “any occupation” definition of disability.
At this stage, you must prove that you are unable to perform any occupation for which you are reasonably suited by education, training, or experience.
This is a much stricter standard.
Insurance companies often terminate benefits at this point.
Why Benefits Are Often Cut Off After Two Years
The transition to the “any occupation” definition is one of the most common reasons disability benefits stop.
Insurers may argue that a claimant can work in a different role, even if it pays less or requires different skills.
However, these decisions are often disputed.
What If Your Benefits Are Terminated?
If your benefits are cut off after the two-year mark, you may have the right to challenge the decision.
As a disability lawyer, I can review:
- the insurance policy
- the medical evidence
- the vocational assessments
- the insurer’s reasons for termination
Many terminated claims are successfully resolved through negotiation or litigation.
